1. Agreement
By downloading, accessing, or using PopSpot ("the App"), you agree to these Terms of Service. If you do not agree, do not use the App.

2. Eligibility
You must be at least 13 years old to use PopSpot. By using the App, you represent that you meet this requirement. Users under 18 must have parental or guardian consent.
3. Account Responsibility
- You are responsible for all activity under your account.
- You must provide accurate information when creating your account.
- You must not share your account credentials.
- You must notify us immediately of unauthorized use at info@ridleycyber.com.
4. Acceptable Use
You agree not to:
- Post false, misleading, or fraudulent events.
- Harass, threaten, or intimidate other users.
- Post content that is sexually explicit, hateful, or promotes violence.
- Impersonate any person, business, or organization.
- Spam the platform with duplicate or low-quality content.
- Attempt to access, scrape, or reverse-engineer the App's backend systems.
- Use the App to promote illegal activities.
- Circumvent or manipulate trending scores through automation or coordinated inauthentic behavior.
- Use the App while driving or operating machinery.
5. User-Generated Content
5.1 Your Content
Events, crowd reports, and other content you post ("User Content") remain your responsibility. By posting User Content, you grant PopSpot a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your content within the App.
5.2 Content Standards
User Content must:
- Be factually accurate to the best of your knowledge.
- Not violate any applicable law or third-party rights.
- Comply with Apple's App Store Guidelines and Google Play policies where applicable.
5.3 Alcohol and Age-Restricted Content
PopSpot may contain references to alcohol-related events (happy hours, bars). This content is available only to users who are of legal drinking age in their jurisdiction. PopSpot does not serve as a venue for the sale or delivery of alcohol.
6. Moderation Rights
PopSpot reserves the right to:
- Remove any User Content that violates these Terms or our community standards.
- Suspend or terminate accounts that repeatedly violate these Terms.
- Hide, flag, or restrict events pending moderation review.
- Act on user reports at our discretion.
We are not obligated to pre-screen content but may do so at any time.
7. Intellectual Property
All App design, code, branding, and non-user content are owned by Ridley Cyber. You may not copy, modify, distribute, or create derivative works from the App without express written permission.
The PopSpot name, logo, and "Houston's Real-Time Pulse" tagline are proprietary marks of Ridley Cyber.
8. Third-Party Services
PopSpot uses Google Firebase for infrastructure. Your use of the App is also subject to Google's Terms of Service. Links to third-party menus and venue websites are provided for convenience; we are not responsible for third-party content.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that:
- Event information posted by users is accurate or current.
- The App will be available at all times or error-free.
- Check-in or proximity data is precise.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RIDLEY CYBER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOST DATA, PERSONAL INJURY, OR PROPERTY DAMAGE.
Our total liability to you for any claims arising from the App shall not exceed $100 USD.
11. Indemnification
You agree to indemnify and hold harmless Ridley Cyber, its officers, employees, and agents from any claims, liabilities, damages, or costs (including legal fees) arising from your use of the App or violation of these Terms.
12. Termination
We may suspend or terminate your access at any time for violations of these Terms. You may delete your account at any time via Profile → Delete Account. Upon termination, your license to use the App ends immediately.
13. Governing Law
These Terms are governed by the laws of Texas, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Harris County, Texas.
14. Changes to Terms
We may modify these Terms at any time. Continued use of the App after changes constitutes acceptance. Material changes will be communicated via in-app notice or email.
